Terms of Service

The agreement between you and EliteRent for using the service. This is a working draft: the structure and the honest description of what EliteRent does are real, but the binding terms still need an attorney’s language before they take effect.
Draft — pending legal review
This document is an internal working skeleton, not a binding policy. It has not been reviewed or approved by an attorney and does not take effect until it is. Sections marked TODO · counsel need real legal language before launch. Do not rely on anything here.
1. Acceptance
By creating an account or using EliteRent, you agree to these terms. If you are using it on behalf of an entity, you represent that you may bind that entity.

2. What EliteRent is — and is not
EliteRent is software that helps landlords operate their rentals. It is not:
- a law firm — generated leases and notices are drafts you must have reviewed by a licensed attorney before use, and every generated document carries a review-before-use notice;
- a CPA or tax advisor — Schedule E figures, depreciation, and tax packages are estimates for your accountant to confirm;
- a bank or money transmitter — EliteRent reads your bank activity read-only and never moves, holds, or collects funds;
- a provider of legal, financial, or investment advice.

3. Accounts and eligibility
You are responsible for your account credentials and for the activity under your account. EliteRent is offered first to North Carolina and Florida landlords during early access; compliance features exist only for supported jurisdictions.

4. Acceptable use
Use EliteRent lawfully. Do not misuse the applicant intake or communications features, attempt to breach security, or use the service to violate fair-housing, privacy, or other applicable laws.

5. Bank connections
Connecting a bank account through Plaid grants EliteRent read-only access to balances and transactions so it can match rent and keep your books. You can disconnect at any time. EliteRent never initiates payments or transfers.

6. Plans, trials, and billing
EliteRent offers a time-limited free trial, then a flat monthly subscription billed through Stripe. Billing features are inert until real payment configuration is in place; the app degrades gracefully without them.

7. Your content and data
Your portfolio data, documents, and records are yours. You grant EliteRent the limited license needed to host and process them to provide the service. Our handling of personal data is described in the Privacy Policy.

8. Third-party services
EliteRent integrates AWS, Plaid, Stripe, and Amazon Bedrock (see the Privacy Policy subprocessors). Your use of those integrations is also subject to the relevant provider’s terms.

9. Disclaimers and limitation of liability
EliteRent is provided on an “as is” basis. Because it is not a law firm, CPA, or bank, you remain responsible for legal, tax, and financial decisions.

10. Termination
You may stop using EliteRent and close your account at any time. We may suspend or terminate access for a violation of these terms.

11. Governing law and disputes
These terms will be governed by a to-be-confirmed jurisdiction.

When these terms are finalized and later updated, we will revise the date at the top and notify account holders of material changes.
